Terms of Use

1. Agreement to These Terms

By accessing or using BenGPT or any related services provided by BenAI Lab (the "Service"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be legally permitted to use the Service in your jurisdiction. If you are under the age required to enter into a binding agreement in your location, you may only use the Service with permission from a parent or legal guardian.

3. The Service

BenAI Lab provides digital AI chat services, subscriptions, and related features through BenGPT. The Service may generate text, summaries, suggestions, and other outputs. Features, models, limits, and availability may change at any time.

We may add, modify, suspend, or discontinue any part of the Service at any time, with or without notice.

4. AI Output Disclaimer

The Service uses artificial intelligence and may generate outputs that are inaccurate, incomplete, outdated, offensive, or not suitable for your needs.

BenGPT outputs are provided for general informational purposes only and are not legal, medical, financial, academic, mental health, or other professional advice. You are solely responsible for reviewing and verifying any output before relying on it.

Your use of any output is at your own risk.

5. Accounts and Security

You may need to create an account to use some or all features of the Service. You agree to provide accurate information and keep it updated.

You are responsible for:

maintaining the confidentiality of your login credentials;
all activity that occurs under your account; and
notifying us promptly if you suspect unauthorized access, misuse, or a security issue involving your account.

6. No Account Sharing

Your account is for your personal use only unless your plan explicitly states otherwise.

You may not:

share your password or login credentials;
allow another person to use your account;
sell, rent, transfer, lend, or sublicense your account; or
use one account for multiple people, including family members, classmates, coworkers, or other third parties.

We may use reasonable security and abuse-detection methods, including login behavior, device/browser signals, IP or location changes, concurrent sessions, and usage patterns, to detect suspected account sharing, fraud, or misuse.

If we reasonably suspect account sharing, fraud, or misuse, we may require verification, restrict access, suspend, or terminate the account.

7. Acceptable Use

You agree not to use the Service to:

violate any law or regulation;
infringe intellectual property, privacy, publicity, or other rights;
generate, distribute, or assist with malware, phishing, credential theft, hacking, fraud, or other harmful activity;
harass, threaten, exploit, abuse, or harm others;
create or distribute sexual content involving minors or exploit minors in any way;
bypass rate limits, payment requirements, usage caps, or security protections;
scrape, reverse engineer, overload, disrupt, or interfere with the Service; or
use the Service in an abusive, automated, bulk, or commercially unreasonable manner not permitted by your plan.

We may investigate suspected violations and may remove content, restrict features, suspend access, or terminate accounts for actual or suspected violations.

8. External Providers

To operate the Service, BenAI Lab may use third-party infrastructure, model providers, hosting providers, payment providers, and related service partners.

By using the Service, you understand that certain requests, inputs, or transactions may be processed by third-party providers as needed to operate, secure, support, or improve the Service.

We do not guarantee uninterrupted availability of any third-party provider.

9. Plans, Billing, and Digital Service Nature

BenGPT is a digital AI service. Paid plans may include subscriptions or other digital access features.

By purchasing a paid plan, you authorize BenAI Lab and/or its payment provider to charge your selected payment method for the fees shown at checkout, including recurring charges where applicable.

Prices, plan features, limits, quotas, and availability may change from time to time. Any changes will apply prospectively unless otherwise required by law.

Because the Service is a digital service that may be delivered immediately upon purchase, all purchases are final except as expressly stated in these Terms or where required by applicable law.

10. Payment Processing

Payments may be processed through third-party payment providers, including Lemon Squeezy where applicable.

Billing, tax handling, payment processing, and refund execution may be handled through such providers, but BenAI Lab determines refund eligibility under these Terms.

11. Fair Use and Abuse Prevention

Certain plans may be described as "unlimited," "fair use," or similar terms. These terms do not allow abusive, excessive, automated, shared, exploitative, or commercially unreasonable usage.

To protect platform stability, cost control, performance, and security, we reserve the right to investigate usage patterns and apply reasonable safeguards where we suspect abuse, including but not limited to:

unusually high-volume or automated usage;
repeated attempts to bypass limits, quotas, or protections;
account sharing or unauthorized multi-user access;
scripted or bot-like behavior;
scraping or exploitative bulk generation;
payment abuse, refund abuse, fraud, or policy evasion; or
any activity inconsistent with normal personal use of the Service.

If we reasonably suspect abuse or misuse, we may, with or without prior notice:

rate-limit usage;
restrict certain features;
require account, identity, or payment verification;
suspend or terminate the account; or
deny refunds where abuse, fraud, or policy evasion is involved.

Our decisions in these situations may be based on internal logs, technical signals, account history, platform integrity concerns, and reasonable risk assessment.

12. Cancellation

You may cancel your subscription at any time to stop future renewals.

Unless otherwise stated, cancellation takes effect at the end of the current billing period. Cancellation does not retroactively refund the current billing period except where Section 13 applies or where required by applicable law.

13. Refund Policy

13.1 General Rule

Because BenGPT is a digital service delivered immediately, all purchases are final and non-refundable except in the limited circumstances described below or where required by applicable law.

13.2 When Refunds May Be Allowed

A refund may be issued only if you provide clear proof that BenGPT's core chat functionality was not working due to a Service-side issue attributable to BenAI Lab, meaning:

you were unable to send messages or receive responses for a sustained period;
the issue was not caused by your device, browser, extensions, internet connection, VPN, proxy, firewall, unsupported setup, or account misuse; and
our logs confirm the failure, or you provide evidence that reasonably demonstrates it.

Refund requests must be submitted within 48 hours of the original purchase or renewal charge.

13.3 When Refunds Are Not Allowed

Refunds will not be provided for:

change of mind;
accidental purchase;
forgetting to cancel;
dissatisfaction with answers, output quality, model style, tone, or response quality;
successful or meaningful use of the Service, including messages sent, responses received, or usage consumed, except in the case of a verified Service-side failure under Section 13.2;
issues caused by your network, extensions, VPN/proxy, device settings, browser, firewall, or unsupported environment;
temporary slowdowns, degraded performance, or intermittent issues that do not make the core chat service unusable;
third-party outages outside our reasonable control;
suspension, restriction, or termination caused by violations of these Terms, suspicious activity, abuse, fraud, or payment risk; or
refund requests that are fraudulent, abusive, or unsupported.

13.4 How to Request a Refund

Refund requests and billing questions must be sent to:

Please include:

order email;
order ID;
date and time of the issue;
your timezone;
screenshots or screen recording if available;
a brief description of what happened; and
relevant request IDs or timestamps, if available.

We may request additional information to verify the claim. We may deny refund requests that do not include sufficient evidence or cannot be reasonably verified.

13.5 Refund Processing

If a refund is approved, it may be processed through our payment provider, including Lemon Squeezy where applicable. Refund timing may depend on the payment provider and your bank or card issuer. Lemon Squeezy's docs state refunds can take up to 10 days to appear on a customer statement.

13.6 Chargebacks and Payment Disputes

If you believe a charge is unauthorized or incorrect, contact us first at lab.benai@gmail.com.

Initiating a chargeback or payment dispute without contacting support first may result in temporary account suspension or restriction while we investigate the issue and protect the Service from abuse.

Nothing in this Section limits any non-waivable rights you may have under applicable law.

14. Intellectual Property

BenAI Lab and its licensors own all rights, title, and interest in and to the Service, including the software, branding, interface, design, and related materials, except for your User Content.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose.

15. Your Content

You retain ownership of the prompts, text, and other content you submit to the Service ("User Content").

You grant BenAI Lab a limited, non-exclusive license to host, process, transmit, store, and use User Content only as reasonably necessary to:

provide the Service;
maintain security;
prevent fraud and abuse;
comply with law;
troubleshoot technical issues; and
provide customer support.

You understand and agree that:

outputs may not be unique;
similar or identical outputs may be generated for other users; and
we do not guarantee that outputs are exclusive, original, non-infringing, or fit for your intended use.

16. Service Availability

The Service is provided on an "as available" basis. We do not guarantee that the Service will always be available, uninterrupted, secure, accurate, or error-free.

17. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service immediately if:

you violate these Terms;
we reasonably suspect fraud, abuse, account sharing, or suspicious activity;
payment cannot be collected, is reversed, or creates risk;
required by law, security, or technical necessity; or
needed to protect the Service, BenAI Lab, or other users.

Upon termination, your right to use the Service ends immediately.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

BENAI LAB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; AND
BENAI LAB'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO BENAI LAB FOR THE SERVICE IN THE THIRTY (30) DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $0 IF YOU DID NOT PAY.

20. Changes to the Service or Terms

We may update the Service or these Terms from time to time. When we update these Terms, we will post the revised version and update the "Last Updated" date above.

By continuing to use the Service after the updated Terms become effective, you agree to the revised Terms.
